LOCALHORST / LEGAL

Terms of service

Last updated: 26 October 2026

Imprint Privacy policy Terms of service

These terms govern the localhorst deployment and hosting service supplied by Marius Steinbach, Endresstraße 94-96 TOP 15, 1230 Vienna, Austria ("localhorst", "we", "us"). Contact [email protected] for contracts, billing and complaints. Our imprint identifies the operator; our privacy policy explains personal-data processing.

localhorst serves adults aged 18 or over, including consumers and business customers. A consumer acts outside their trade, business or profession. Mandatory consumer rights take priority over these terms. Acting for an organisation requires authority to bind it.

1. Your contract and account

The order summary identifies the customer, service, region, resource limits, rates and billing method. You can review and correct your choices before ordering. A paid service contract is formed when we accept your order and send confirmation to your supplied email address. Account registration alone does not order every advertised product. Service provision starts at the time stated in the accepted order, subject to any required request for early performance.

The contract consists of the accepted order and the version of these terms supplied with it. A specifically agreed order term takes priority over a general term, subject to mandatory law. Any applicable data processing agreement governs the processing entrusted to us. The privacy policy is a notice, not a request to waive rights or consent to all processing. The contract language is English. Keep your order confirmation and terms; you can save or print this page.

Provide accurate account and billing details, keep them updated, protect your sign-in and API credentials, and tell us promptly about suspected unauthorised access. Manage workspace permissions carefully. A workspace member may act only within their authority; workspace membership alone does not make someone personally liable for another customer's bill. You remain responsible for actions you authorise, subject to applicable law.

2. Services and responsibilities

localhorst builds and hosts applications from supported deployment inputs, provides the resources ordered, and supplies any selected add-ons such as monitoring, backup storage, managed databases or application authentication. The accepted service description and resource limits define what is included. Selecting a hosting region determines application placement as described in the order; it does not place every supporting provider or central account service in that region.

You supply the application, lawful content, configuration and licences needed to operate it. Check compatibility with the supported deployment format, maintain your application dependencies, and protect application credentials and access controls. Upload only files needed for the build; exclude unrelated personal files, private keys and local secret files. Use the designated secret-configuration facilities for runtime secrets.

Before deleting data, cancelling storage or making a destructive change, export what you need. Backup and recovery features have the scope and retention selected in your order, with a maximum backup age of 90 days. A backup option does not promise a recovery point, recovery time or successful recovery in every circumstance. These responsibilities do not exclude our contractual or statutory duties.

3. Prices, daily billing and payments

Rates are in EUR. Business net rates exclude VAT; applicable VAT is added where due. Consumer price information and the final order must show applicable taxes and mandatory charges, together with the calculation method where the final usage total cannot be known in advance. A net-rate reference does not authorise undisclosed charges. Your accepted order determines the applicable rates.

  • Billing day: a calendar day from 00:00 to 24:00 UTC, regardless of your local time zone.
  • Packages: charged for each started day of use, for each applicable billing unit such as a running instance. Starting late in the day still incurs that day's package charge. A monthly invoice does not create a minimum month-long commitment.
  • Additional usage: measured in five-minute intervals; each started interval is billable at the ordered rate and quantity. An additional minute within an already charged interval is not another interval. Starting a new interval incurs its charge.
  • Monthly-rate items: converted using the actual number of calendar days in the relevant UTC month. For example, a €3.10 monthly unit rate is €0.10 per day in a 31-day month, before applicable tax. Where a time-metered extra has a monthly rate, its five-minute unit rate is the monthly rate divided by the days in that month and by 288; billable quantity is then applied.
  • Usage quantities: charges follow the unit stated for the item, such as instances, retained GB, enabled services or application users. Resource allocation or retained storage may be billable even when traffic or CPU activity is zero. We do not bill the same resource twice as both an included package allowance and an extra.

Charges accrue as services are used and are invoiced monthly in arrears through Stripe. By completing the payment authorisation, you authorise collection of properly accrued recurring and usage charges using the selected payment method, subject to the payment-method rules. We give the applicable billing calculation and any payment timing in the order and invoice. Stripe is the payment provider; localhorst remains your service-contract partner.

Subscriptions continue automatically until cancelled. Renewal does not impose an additional fixed monthly term. Add-ons require an order; they are not purchased merely by creating an account. We do not charge for service periods after cancellation takes effect, except separately retained resources and charges already accrued under the rules above.

There is no discretionary refund for correctly billed usage or a started package day solely because you stopped using it. This does not restrict withdrawal rights, statutory refunds, price reductions, correction of an incorrect charge or other mandatory remedies. Tell us about a disputed invoice at [email protected]; contacting us does not shorten any legal dispute period.

4. Renewal, cancellation and retained data

You may cancel a service or add-on on any day through its account controls or by an unambiguous request to [email protected] identifying the account and service. There is no minimum term or cancellation fee. Cancellation takes effect when submitted through the controls or when we receive your request, unless you select a later time. We confirm the effective time. We may verify your authority before carrying out a destructive request, without using that check to extend a valid cancellation's billing period.

Extra usage stops accruing when cancellation takes effect; the last started five-minute interval remains chargeable. A package day that has already started remains payable, and cancellation prevents the next UTC day's renewal. You remain liable for charges accrued before cancellation, including the final invoice after cancellation.

Stopping compute does not delete storage or backups. Retained persistent storage and backups continue to incur their disclosed usage charges until you delete them or cancel the retained resource. You may choose to retain them, subject to the 90-day maximum age for a backup. The cancellation confirmation must identify anything retained and still billable; if you request cancellation of all paid resources, we do not silently renew a separately retained resource.

Deleting an application, its data or a backup can be irreversible. Export needed data first, or request the switching process in section 10. Uploaded source archives are retained only as needed and for at most 48 hours after upload; they are not a source-code backup service. Account closure does not erase invoices or other records we must lawfully retain, as explained in the privacy policy.

5. Consumer right of withdrawal

If you are a consumer entitled to withdraw under Austrian or other applicable mandatory distance-contract law, the following applies separately from ordinary daily cancellation.

Withdrawal instructions

You have the right to withdraw from the service contract within 14 days without giving a reason. The withdrawal period expires 14 days after the day the contract is concluded.

To exercise this right, inform Marius Steinbach, Endresstraße 94-96 TOP 15, 1230 Vienna, Austria, [email protected], of your decision by an unambiguous statement, for example a letter or email. You may use the model form below, but it is not obligatory. Sending your statement before the withdrawal period expires is sufficient.

When you withdraw, we reimburse payments received for that contract without undue delay and no later than 14 days after being informed of your decision, using the same payment method unless you expressly agree otherwise, without a reimbursement fee. Any amount lawfully due for service already provided is addressed below.

If you expressly requested performance during the withdrawal period and received the required information, you pay only an amount proportionate to what was supplied until you informed us of withdrawal, compared with the contract's full coverage. Ordinary started-day or rounded-interval charges do not override that statutory calculation. Without the required early-performance request or information, no such charge is due where the law so provides.

Starting continuous hosting does not by itself remove the right of withdrawal. For a paid service, the right is lost on full performance only where the required express prior consent and acknowledgement of that consequence were obtained. Merely accepting these terms is not a separate early-performance request or waiver.

Model withdrawal form

Complete and return this form only if you wish to withdraw from the contract.

To: Marius Steinbach, Endresstraße 94-96 TOP 15, 1230 Vienna, Austria; [email protected].

I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the provision of the following service:

  • Service and order/account reference:
  • Ordered on / contract concluded on:
  • Name of consumer(s):
  • Address of consumer(s):
  • Signature of consumer(s), only if submitted on paper:
  • Date:

(*) Delete as appropriate.

Other mandatory withdrawal rights applicable to you remain unaffected. Business customers have no consumer withdrawal right.

6. Acceptable use and illegal-content reports

Use the service lawfully and respect other people's rights. You must not host or distribute illegal material, infringe intellectual property or privacy rights, deliver malware or phishing, send unlawful spam, access systems without permission, evade access/resource limits, or interfere with the security or availability of others' services. Do not use misleading account or billing details to obtain service or evade a restriction.

Reporting illegal content

Send notices to [email protected]. Include:

  • a sufficiently explained reason why the specific content is allegedly illegal;
  • its exact URL or other precise location, with information needed to identify it;
  • your name and email address, except where the law permits omission, including applicable reports concerning sexual abuse of children; and
  • a statement that you believe in good faith that the information and allegations are accurate and complete.

Where contact details are supplied, we acknowledge receipt and communicate our decision and available redress without undue delay. We assess reports diligently, objectively and proportionately, considering applicable law, these terms, context and affected rights. Security tools may flag activity or block attacks automatically; content restrictions are subject to human review. We explain any use of automated means relevant to a reported-content decision.

Where we restrict hosted content or an account because content is illegal or breaches these terms, we provide the affected customer with the specific reasons, scope and duration, legal or contractual basis, relevant automation and available challenge routes, except where a lawful exception applies. Request review at the abuse address with the decision reference and relevant evidence. This review does not limit court remedies or other mandatory complaint rights.

7. Your content and personal data

You retain ownership of your application, source and other content. You grant us only the rights needed to receive, copy, build, store, transmit and operate that content to provide your ordered services, carry out your instructions and meet legal obligations. This does not grant a right to sell your source code, market your private content or train general-purpose AI models on it. Necessary service providers may act within the same service purpose and applicable confidentiality obligations.

You are responsible for having the rights and lawful basis needed for your content and for your application's processing of other people's data, including notices, permissions and appropriate application security. Where we process personal data for you, an Article 28 GDPR data processing agreement must be in place before that processing begins. It must address the processing scope, security, subprocessors, transfers, assistance, incidents and return/deletion. Your responsibilities do not displace ours. The privacy policy explains the distinction between customer data and our own account/billing processing.

8. Availability, defects and liability

We provide the services with reasonable care and skill and as required by the contract and applicable law. Maintenance, security work and faults can interrupt service. No numerical uptime, response-time, support or recovery service-level agreement is included. This does not exclude obligations of conformity, required security updates, statutory warranty or remedies for a defective digital service.

Report defects to [email protected] with enough information to identify the affected service. Consumers retain their statutory rights, including having the service brought into conformity and, where the legal conditions are met, a price reduction or termination and reimbursement. A daily cancellation option is not a substitute for these remedies.

Liability is determined by applicable law. These terms do not impose a contractual liability cap or exclude liability for personal injury, intentional misconduct, gross negligence, fraud, or any liability or remedy that cannot lawfully be excluded. A customer's backup or security responsibility does not automatically remove a claim for loss caused by our breach.

9. Suspension and termination by localhorst

We may restrict the affected service where reasonably necessary to address a material breach of these terms, overdue payment, a concrete security threat or a binding legal requirement. Restrictions must be proportionate to the reason. Where practicable, we notify you of the issue and give a reasonable opportunity to resolve it before restricting access. Urgent protective or legally required action may be immediate, with reasons and review information supplied when legally permitted.

We may terminate for a material breach that is not remedied within a reasonable notified period, or for a sufficiently serious breach or legal requirement justifying immediate termination. We do not use termination to remove accrued consumer remedies or switching/retrieval rights. We identify the effective date, remaining charges and data-retrieval arrangements. A restriction caused by our own failure does not itself entitle us to charge for service not supplied; mandatory price-reduction and refund rights remain available.

10. Export and switching providers

You may request export or switching assistance at [email protected], identifying the services and whether you want to move to another provider or your own infrastructure. Do this before instructing irreversible deletion. Exportable customer data includes your supplied application data and source still held, service configuration, and input/output data and metadata generated through your use, subject to others' rights and security. It excludes our own protected software, trade secrets and other customers' data.

Where the EU Data Act applies, we facilitate switching without contractual, commercial or technical obstacles prohibited by that Act. No longer notice period is imposed by this section than the daily cancellation rule. The ordinary transition period is no more than 30 calendar days. If technically unfeasible, we explain the reason within 14 working days and identify an alternative period of no more than seven months; you may extend the transition once for a period appropriate to your needs.

We provide reasonable assistance, continuity and security during the transition and at least 30 calendar days for retrieval after the agreed transition ends. We then erase exportable customer data and assets as required, subject to legal retention obligations or an earlier deletion instruction you validly give. Do not use an immediate-delete control if you want the retrieval period. Normal, disclosed service charges apply to services you continue to use or expressly retain; there is no early-termination penalty. Switching charges, if any, must comply with the Act, and no switching charge applies from 12 January 2027. No additional switching charge applies unless lawfully disclosed and agreed before the order.

We explain the available methods, formats, known limitations and assistance for the affected services before the switch. A switch does not promise identical third-party features or override lawful technical and intellectual-property limits. These limits do not remove our statutory switching duties.

11. Service and contract changes

We may make changes needed to maintain conformity, security and legal compliance. Other changes to an ongoing consumer digital service require a valid contractual reason, such as adapting to a documented technical dependency or interoperability change, and must meet applicable law. Such a change is made without additional cost, is explained clearly, and does not give us a general right to remove the service's essential characteristics.

For a change that more than minimally impairs a consumer's access or use, we provide reasonable advance notice on a durable medium describing the change, its timing and the right to terminate without charge. Where applicable, that right may be exercised within 30 days after receiving the notice or the change taking effect, whichever is later, unless an unchanged conforming service remains available without extra cost.

New prices and amendments to the contractual terms require your agreement where required by law; they do not alter charges already accrued. We give advance information about a proposed change and the option to cancel before it takes effect. Your silence, a new website date or continued website browsing alone is not acceptance of new payment obligations.

12. Law, complaints and disputes

Austrian law governs the contract, excluding its conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections of the law that would otherwise apply, including applicable protections of your country of habitual residence. Jurisdiction follows the applicable rules; these terms do not require consumers to sue only in Vienna.

Send complaints to [email protected] or the postal address above. We review the issue and respond through the supplied contact channel. Where a dispute cannot be resolved directly, we provide information about any applicable alternative dispute-resolution body and our participation as required by law. Court remedies remain available.

If a provision is ineffective, mandatory law and the remaining valid provisions apply. No provision is automatically replaced with a term that preserves an unlawful economic effect.
